Terms of Service

These Terms of Service (“Terms”) govern your access to and use of PROSPECTS(the “Service”), including our website and the data products we sell. By accessing the Service or purchasing a product, you agree to these Terms. If you do not agree, do not use the Service.

1. What we provide

PROSPECTSsells curated lists of business contact information (“Lists”) as digital products, delivered as downloadable files (e.g. CSV). The data is compiled from publicly available sources and enrichment providers, and is intended for lawful business-to-business (B2B) purposes such as outreach and prospecting.

2. Your responsibilities & acceptable use

You agree that you will:

• use the Lists only for lawful B2B purposes and comply with all applicable laws and regulations governing electronic communications and data protection, including (where applicable) the CAN-SPAM Act, CASL, GDPR, and India’s data-protection laws;
• honor opt-out/unsubscribe requests and respect the rights of the individuals and businesses in the data;
• not resell, redistribute, sublicense, or publicly post the Lists, in whole or in part;
• not use the Service to send spam, unlawful, deceptive, or harassing communications.

You are solely responsible for how you use the data and for the content of any communications you send. We are not responsible for your compliance with applicable laws.

3. License

Upon purchase, you receive a limited, non-exclusive, non-transferable license to use the purchased List for your own internal business purposes, subject to these Terms. All intellectual property in the Service and in our compilations remains ours.

4. Orders, payment & delivery

Prices are shown at checkout. Payments are processed by our authorized payment provider, which may act as the merchant of record for your transaction; your purchase is also subject to that provider’s terms. Products are digital and are delivered electronically (typically immediately) after a successful payment. You are responsible for any taxes shown at checkout.

5. Refunds

Because products are delivered instantly and cannot be returned, sales are generally final. See our Refund Policy for details and the limited circumstances in which we offer a remedy.

6. Disclaimers

The Service and the data are provided “as is” and “as available.” While we work to keep the data fresh and accurate, we do not warrant that it is complete, current, or error-free, or that any use of it will achieve a particular result. To the maximum extent permitted by law, we disclaim all implied warranties.

7. Limitation of liability

To the maximum extent permitted by law, PROSPECTS will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues. Our total liability for any claim arising out of or relating to the Service or a product will not exceed the amount you paid for that product.

8. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

9. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-laws principles, and the courts located in India will have jurisdiction, unless applicable law requires otherwise.
